What Type of Buildings Require Fire Clearance Certificate or FIRE NOC

As a result of modernization and the changing needs of society, there is an increasing trend of high-rise buildings in India. The purpose is not only limited to housing, but also extends to business, communities and even services. There has been tremendous growth in the real estate industry since the last decade and now fully occupied high-rise or multiplex buildings can be seen in the urban cities of India.

Buildings above 15 meters are called high-rise buildings, which are in the form of malls, hospitals, apartments and multiplexes. Unfortunately, some serious accidents have occurred in buildings that are whistleblowers for the protection of an accident-free environment. In order to be safe, the government has secured the armor under the latest Right to Information rules. There are also amendments to the Factories Act 1948 which provide for provisions relating to hazardous processes. Accordingly, all types of high-rise buildings must have a fire certificate or FIRE NOC.

What is a FIRE NOC or Fire Clarification Certificate?

A FIRE NOC or Fire clearance certificate is a no-objection certificate that indicates that the building has been designed according to the norms and regulations that a high-rise building should have to avoid dangerous accidents. This is issued by the fire department of the respective state before the construction of the building. Before construction, the construction authority applies to TŰZNOC with the corresponding construction plan attached. The building plan should include full details including structure, stairwell design, electrical supply, lift design, open space, fire exit, material, design and should have the following:

1. Fire safety measures, fire extinguishers and fire extinguishing measures to be installed in the building.

2. Minimizing the spread and intensity of fire within the building and any other building.

3. Controlling the generation or spread of smoke as much as possible.

4. Implementation of a device that can detect the Fire and warn the occupants or the user.

5. Instant access to device to control ascending fire.

6. The plan must be designed by the registered architect.

FIRE NOC for hospitals:

The Government has issued a full directive under the National Building Code of India (2005) “4. “Fire and life safety” regarding the fire prevention and fire safety of the hospital building. The hospital construction plan must include the following Hospital Engineering Service Specification for fire precautions as per NABH (National Accreditation Board of Hospitals and Healthcare Providers).

NABH provisions regarding the Hospital’s fire protection precautions:

• Installation of fire extinguishers requires a permit.

• Easy access to control room location.

• The control panel must be connected to the fire alarm or alarm system.

• Availability of pump rooms including electrical and diesel room.

• Rules for submitting fire protection tenders.

• In the event of an emergency, there must be a 4-way fire entrance.

• Forced ventilation

• Easy access to fireproof containers

• A fire drill must be carried out.

• Adequate availability of yard hydrants and landing hydrants and should be strategically located.

• 2-way fire heads.

• Hose reels and air valves

• Wet Riser system

• First aid equipment must be functional.

• An escape route and an emergency exit must be provided.

• Automatic equipment for smoke or heat detectors.

• Fire alarm system and fire extinguishers

Regulations according to the 2005 National Building Regulations:

1. All high-rise buildings must have a Fire NOC as per the zoning regulations of the respective jurisdiction.

2. The road should be wider than 12 meters, especially the hydraulic platform and turntable ladder.

3. The size of the entrance cannot be smaller than 6 or 5 meters.

4. At least 40% of the users or passengers must be trained in the proper operation of the fire safety equipment or evacuation system.

5. In addition to the usual stairs, adequate open space and emergency exit stairs must be provided on the outer wall of the building.

6. The entrance to the lobby must be closed with two-hour fireproof smoke-proof swing doors.

How to request a fire protection certificate:

The pre-formatted application form together with the business plan and documents must be submitted to the Fire Department of the respective state. The application must be properly sealed and signed by the authorized civil engineer or authority. It should include the full site address and all the provisions mentioned above in the business plan and documents. Many states now accept online application forms, but the attachments will be the same. The process of issuing Fire NOC is exempted from fees.

Documents required:

1. 2 sets of building plans approved by the Building Authority.

2. The model of the building.

3. Complete drawing of the building and its surroundings.

4. Complete construction plan with the mandatory data mentioned above.

5. The checklist must be certified by the authority.

Duration required to issue FIRE NOC:

If the application is filled out correctly with the exact business plan, it usually takes 4 weeks for the Fire Department to issue a Fire Protection Certificate.

Is the Fire NOC valid?

As per Rule 35, Fire NOC is valid for 5 years for residential buildings and 3 years for non-residential buildings.

All users are strongly advised to strictly follow the provisions and procedures not only on paper but also in practice. Fire safety and precaution is one of the most important factors that affects everyone in the hospital industry. The main goal of fire safety planning is to ensure life safety, continuous operation and adequate protection.
