I Want My 400 Pounds! – Trucking, APUs And Weight Allowances

There is a lot of buzz these days about APUs (Auxiliary Power Units or Generators). Yes, the federal government allows up to 400 pounds for trucks equipped with an APU—or any device used to reduce fuel consumption and emissions. It’s part of the idling reduction strategy — encouraging truckers and trucking companies to install APUs. But that doesn’t mean you can always get it.

The text of the law says that any vehicle with an APU “must have a maximum gross, axle, tandem or bridge weight limit of 400 pounds” – a tractor-mounted generator does not allow for a bridge law exception. .

The problem is that while the federal government allows weight lifting, states don’t have to. This means they can allow up to £80,400 in one state. but may be limited to £80,000 in the next state. despite the decision of the federal government. Many states already have weight tolerances above the 400-pound weight allowance, so the ruling doesn’t really affect enforcement procedures.

Great in theory, but worthless in practice.

What we’ve run into is that many officers are unaware of the federal decision, so even though a state legislature has passed the £400 allowance, enforcement officers are unaware of it. States that have adopted a 400-pound weight limit (weigh station officers may not be aware of it):

Arkansas

Arkansas allows an additional 400 pounds on an axle to account for the APU, but does not allow more than 80,000 pounds of gross weight.

California

Idaho

Maine

Maryland

Michigan

Michigan allows 400 pounds for an APU. The problem you may run into is that no weigh station officers were aware of the federal ruling, and the Michigan Center for Truck Safety was under the impression that Michigan had not accepted the ruling, but could not say for sure. According to Lt. Dave Ford, Michigan does respect the 400 lb ruling. Operators must document the APU weight from the manufacturer and verify that the documented APU was installed on that unit (not with another APU).

North Dakota

Oregon

Oregon Senate Bill 223 officially allows an additional 400 pounds within the gross weight limits for trucks equipped with APUs (auxiliary power units). Oregon abides by the federal ruling and requires written proof of APU crowd. Oregon motor carrier authorities have allowed a 400-pound weight exemption since February 2006. The APU must be operational.

Virginia

The 400-pound weight exemption is only allowed on interstate highways. Drivers on state routes are subject to Virginia’s standard gross and axle weight enforcement.

Washington

States that have not adopted the 400-pound weight exemption and:

* has a weight tolerance (for balance deviation)

* Has low premiums and won’t charge you for being 400 pounds overweight

*and states whose officers are very unlikely to give tickets unless provoked – officer discretion is also a factor (officers in many of these states were unaware of the 400lb exemption but said 400lbs was too low for them bother with it):

Connecticut

Officials at the Greenwich weighing station were unaware of the federal decision, but said it was unlikely they would issue a citation for such a small amount. This section of I 95 is limited to 80,000 pounds regardless of what licenses the driver carries, so the limit is 80,000 pounds. It could result in a £80,001 ticket, but this is unlikely until the truck reaches £81,000, at the discretion of the officer. The official word from the Office of Commercial Vehicle Enforcement is that Connecticut has not adopted the 400-pound weight exemption.

Colorado

Delaware

Georgia

Florida

Kentucky

It’s entirely at the discretion of the officer – you’re unlikely to get a ticket for £400.

Louisiana

Montana

New Mexico

North Carolina

Officers at weigh stations in North Carolina we called didn’t know about the federal 400-pound allowance, but said they have a 500-pound tolerance they allow before they write tickets.

South Dakota

Officers won’t disclose their tolerances, but say their tolerances exceed 400 pounds, so while the Legislature hasn’t passed a federal standard yet, their current standards allow for the increased weight.

Utah

Henefer POE officers say they allow up to 500 pounds for an APU. Other POE officers were uncertain about the law.

West Virginia

Wyoming

Officers at the Cheyenne I 25 nb weigh station say they will pass up to 500 pounds without a ticket.

States that do not allow 400 pounds for an APU (based on inquiries – subject to change):

Alabama, Arizona, Indiana, New Jersey

To claim the £400 allowance you must:

* certified weight of the APU in writing (if the APU weighs only 380 pounds, only 380 pounds is allowed)

* authentic proof (or able to prove) that the APU is operational (working)
